UPDATE: State petitions Supreme Court on Rinehart appeal

In the seemingly unending saga of California's statewide ban on suction dredge mining, the State of California has petitioned the California Supreme Court to overturn the California Court of Appeal, Third Appellate District decision in favor of Brandon Rinehart.

In the seemingly unending saga of California's statewide ban on suction dredge mining, the State of California has petitioned the California Supreme Court to overturn the California Court of Appeal, Third Appellate District decision in favor of Brandon Rinehart.

The state has also requested that the published decision by the appellate court be "depublished."

The petition is unfavorable to miners who successfully petitioned the appellate court to have the opinion published when Rinehart's conviction for dredging without a permit was overturned in late September. 

 

11/24/14 Update

According to The People v Rinehart website and James Buchal, Brandon Rinehart's attorney, "…the State petitioned for Supreme Court review, they also asked the Court to depublish the opinion by separate letter.  Unfortunately, the response to this letter is on a ten-day clock.  Any letters in opposition to the depublication request must be delivered to the Supreme Court by November 27th."

Please note any person may submit a response supporting or opposing the request. A response submitted by anyone other than the rendering court must state the person's interest.
