Just got an email from the infamous GRE (Gold Rush Expeditions) trying to sell me a Lode Claim here in Montana. (side note - nobody should ever NEVER buy from them). The claim is a Lode however they state that it is 20 Acres. How can they do that? Please correct me if I am wrong, but as I understand it the maximum size for a lode claim is 1500 feet by 600 feet, that is nowhere near 20 Acres. I am not an attorney in my mind this should invalidate any claim they are making as it is against the code of federal regulations (43 CFR Part 3832.22). § 3832.22 How much land may I include in my mining claim? (a) Lode claims. Lode claims must not exceed 1,500 by 600 feet. If there is a vein, lode, or ledge, each lode claim is limited to a maximum of 1,500 feet along the course of the vein, lode, or ledge and a maximum of 300 feet in width on each side of the middle of the vein, lode, or ledge.

1500' * 600' = 900,000' / 43560' = 20.66, as in acres. Same size as most lode claims.

I'd do some due diligence if you're truly interested. Lode claims and hard rock mining are the next level. I'd check the BLM or mylandmatters.org for claims in the area. If this is the only claim or one of the few claims in the area, not a good sign. Also, a google search will reveal some minedat data for the claims in the area. Most claims I see for sale are not worth the cost it took to post them on craigslist. If the searches prove promising, often times there is land open next to what is for sale for claim.

As far as I am concerned, this would not be a criminal legal issue, it would just wouldn't be a legitimate claim and should be tossed out, and is further evidence that they are just a bunch of crooks... newbs won't know this. Of course, I am not an attorney, this is just my opinion. I have worked with BLM on personal claims in two different states. Before it was CA, now another NW state. How they work with miners can vary. Sometimes they will just toss out claims with this type of error, others they bend over backwards to work with/educate the miner and allow them to make changes so the claim can be kept. This group does not deserve that courtesy. If they are going around the country grabbing up every piece of dirt they can find then selling it as a claim, at least they should know the regs and stick to them.
